Pricing Terms and Conditions
Via Her, Inc is not a booking agent and does not charge any service fees to users of our site. However, you should be aware that agents who list travel packages with us may not have included all fees and surcharges in their listed prices. Airfares, in particular, are frequently subject to additional fees (many of which are required by law). Examples include the Federal September 11th Security Fee, international departure and arrival taxes and fees, federal excise tax, and other service, handling and miscellaneous fees and surcharges. When you book with one of our partners, please be sure to check their site for a full disclosure of all applicable fees as required by the U.S. Department of Transportation.

Furthermore, Via Her, Inc makes no guarantees for availability of prices advertised on our site. Listed prices may require a stay of a particular length or have blackout dates, qualifications or restrictions.

Ownership and Copyright
Except as otherwise indicated, the Site, and all text, images, marks, logos and other content contained herein, including, without limitation, the Via Her logo and all designs, text, graphics, pictures, information, data, software, sound files, other files, Content (as defined below) and the selection and arrangement thereof (collectively, the "Site Content") are the proprietary property of Via Her or its licensors or users and are protected by U.S. and international copyright laws. Via Her grants you a limited, nonsublicensable license to access and use the Site and to view, copy and print portions of the Site Content. Via Her's right to disclose any such information shall govern over any terms of Via Her's Privacy Policy.

Right to user content

Without limiting the foregoing, Via Her reserves the right to use the Content as it deems appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. Via Her is under no obligation to offer you any payment for Content that you submit or the opportunity to edit, delete or otherwise modify Content once the it has been submitted to Via Her. Via Her shall have no duty to attribute authorship of Content to you, and shall not be obligated to enforce any form of attribution by third parties.

Advertisements and promotions
Via Her may run advertisements and promotions from third parties on the Site. Your business dealings or correspondence with, or participation in promotions of, advertisers other than Via Her, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. Via Her is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third-party advertisers on the Site.

Copyright complaints policy
Infringement Notification:

If you believe in good faith that materials hosted by us infringe your copyright, please provide the written information requested below. The procedure outlined below is exclusively for notifying Via Her that your copyrighted material has been infringed.

Please provide the following information in the following format (including Section Numbers):

1. A clear identification of the copyrighted work you claim was infringed.
2. A clear identification of the material you claim is infringing the copyrighted work, and information that will allow us to locate that material on the Website, such as a link to the infringing material.
3. Your contact information so that we can reply to your complaint, preferably including an email address and telephone number.
4. Include the following statement: "I have a good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law."

Repeat Infringer Policy
In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law, Via Her has adopted a policy of terminating, in appropriate circumstances and at Via Her's sole discretion, subscribers or account holders who are deemed to be repeat infringers. Via Her may also at its sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Registration Data; Account Security
You agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security of your password; (c) maintain and promptly update the Registration Data, and any other information you provide to Via Her, and to keep it accurate, current and complete; and (d) accept all risks of unauthorized access to the Registration Data and any other information you provide to Via Her.

VIA HER EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT AS TO THE SERVICES, INFORMATION, CONTENT AND MATERIALS ON THE SITE. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF VIA HER, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF THE SITE EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO VIA HER FOR ACCESS TO OR USE OF THE SITE.

BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Applicable Law and Venue
The Site (excluding Third-Party Sites) is controlled by Via Her, Inc and operated by Via Her, Inc from its offices in and around Needham, Mass. While Via Her has made no effort to publish the Site elsewhere, the Site is accessible in all 50 states of the United States and in other countries. You and Via Her both benefit from establishing a predictable legal environment in regard to the Site. Therefore, you and Via Her explicitly agree that all disputes, claims or other matters arising from or relating to your use of the Site will be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflicts of law principles. You agree that all claims you may have against Via Her, Inc arising from or relating to the Site will be heard and resolved in a court of competent subject matter jurisdiction located in Boston, Mass. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts. If you choose to access the Site from locations other than Boston, Mass., you will be responsible for compliance with all local laws of such other jurisdiction.

Termination/Modification of License and Site Offerings
Notwithstanding any provision of these Site Terms, Via Her reserves the right, without notice and in its sole discretion, without any notice or liability to you, to (a) terminate your license to use the Site, or any portion thereof; (b) block or prevent your future access to and use of all or any portion of the Site, Site Content or Services; (c) change, suspend or discontinue any aspect of the Site, Site Content or Services; and (d) impose limits on the Site, Site Content or Services.

Severability
If any provision of these Site Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Site Terms and shall not affect the validity and enforceability of any remaining provisions.
